Terms of Service

These Terms form an agreement between Mappinest, vl. Boris Vitlic, Ekonomija 7, 21325 Tucepi, Split-Dalmatia County, Croatia ("Mappinest", "we", or "us"), and the person or organization using our Services or Products ("Customer" or "you"). You accept these Terms when you access or use a Service or Product. Do not use Mappinest if you do not accept them.
Definitions
"Services" means Mappinest's cloud-based map hosting and delivery platform, including the Tiles API, Maps API, account console, documentation, and other online features or infrastructure that we operate and make available to you.
"Products" means self-hosted packages, downloadable data, software, containers, and other materials that Mappinest provides for installation or use on the Customer's own infrastructure.
"Consumer" means a Customer who uses the Services or Products for purposes outside that person's trade, business, craft, or profession.
Signing up
- Some Services require a Mappinest account. You must provide accurate account information and keep your contact details current.
- Accounts are available only to people who are at least 18 and legally able to enter a binding agreement. If you act for an organization, you confirm that you are authorized to accept these Terms for it.
- Requests to the Mappinest APIs must include an API key issued through your account. The key identifies the account and applies its access rules, usage limits, and billing settings to the request.
API keys and usage
- An API key used in a browser is visible to the people who use that application. Treat it as a public client credential and restrict it with the appropriate key type, allowed domains, scopes, and permitted resources. Domain restrictions rely on the browser's Origin header and do not turn a browser key into a secret.
- Keep server API keys out of browser code, public repositories, and other client-side applications. Rotate or revoke a key if it is exposed, shared outside its intended use, or otherwise compromised.
- You are responsible for activity under your account and API keys. You must not bypass access controls, evade plan limits, overload the Services, or use them unlawfully. We may apply rate limits, quotas, or other usage restrictions to protect the Services and their users.
Customer Content
- "Customer Content" means data, files, tilesets, styles, metadata, and other material that you upload, submit, or store through the Services. You keep ownership of Customer Content.
- While Customer Content remains in the Services, you grant Mappinest a non-exclusive, worldwide, royalty-free license to host, store, copy, process, convert, cache, transmit, and display it only to provide, maintain, secure, and support the Services or comply with law. Our infrastructure providers may exercise these rights only on our behalf for the same purposes.
- You represent that you have the rights, permissions, and lawful bases needed to use Customer Content and authorize the processing described here. If you are not a Consumer, you will indemnify Mappinest against a third-party claim to the extent it results from unlawful Customer Content or your material breach of this paragraph. We will notify you of the claim, provide reasonable cooperation, and allow you to control its defence and settlement, provided that a settlement does not impose an admission or obligation on Mappinest without our written consent.
- The license granted in this section ends when your Customer Content is deleted from the Services or your account is terminated. Copies may remain temporarily in caches or backups and may be retained when required by applicable law, but they will remain subject to the limits in this section.
- You are responsible for maintaining an independent backup of your Customer Content. Mappinest uses commercially reasonable technical and organizational measures designed to protect Customer Content, but the Services are not intended to be your sole archival copy and we do not guarantee that Customer Content will never be lost or corrupted. Any liability for loss or corruption of Customer Content is subject to the Limitation of Liability section and any liability that cannot be excluded under applicable law.
Privacy Policy
Our Privacy Policy explains what personal data Mappinest processes, why it is used, and the rights available to affected individuals.
Our Content
- Mappinest retains its rights in the software, documentation, map styles, branding, and other materials it creates. Subject to these Terms, you may use those materials through the Services or Products for your personal or internal business purposes. You must not remove ownership or attribution notices that accompany them.
- Map styles, tiles, data, and software may include material from third parties. Their licenses and attribution rules continue to apply. When a map style or Product specifically requires Mappinest attribution, display "© Mappinest" with a link to https://www.mappinest.com/copyright.
- You must preserve all attribution notices and links identified in the applicable StyleJSON, TileJSON, documentation, Product materials, or third-party license. When a map uses OpenStreetMap data, the attribution must credit "© OpenStreetMap contributors" and link to https://www.openstreetmap.org/copyright where linking is possible.
- Mappinest attribution does not replace credits required by OpenStreetMap or another provider. Keep all required attribution readable and reasonably accessible on interactive maps, printed maps, static images, and video.
Charges, billing, and payment
- The Services may include a Free plan and optional paid billing features. Creating an account or using the Free plan does not by itself activate PAYG, a paid plan, or automatic charges.
- Before you activate PAYG, choose a paid plan, purchase a Product, or enter into an order form, we will show the applicable fees, included quotas, overage rates, billing period, taxes, and payment terms. By completing that process, you authorize the charges presented to you.
- Free PAYG applies only after you expressly activate it. It covers eligible usage above the included Free quotas according to the rates and conditions shown when you activate it. You may disable PAYG for future usage, but charges already incurred remain payable.
- Flex is a recurring monthly plan with included usage quotas. Usage above those quotas is billed at the overage rates shown at checkout or on the Pricing page. Pro and other custom arrangements are governed by the applicable order form or written agreement.
- Current prices and quotas are shown on the Pricing page, during checkout, or in an order form. If those sources conflict, the order form applies first, followed by the checkout terms and then the Pricing page.
- Usage-based charges are calculated from Mappinest's records of authenticated requests and other billable activity. If you believe a charge is incorrect, contact us promptly and we will review the relevant usage records in good faith.
- Payments may be processed by Stripe or another payment provider identified during checkout. You must provide accurate billing information and keep an authorized payment method available while recurring or usage-based billing is active.
- Prices exclude applicable taxes unless stated otherwise. You are responsible for taxes charged on your purchase or use of the Services or Products, except taxes based on Mappinest's income. Fees already incurred are non-refundable except where an order form, these Terms, or applicable law provides otherwise.
Consumer rights
If you are a Consumer, nothing in these Terms limits rights that cannot be waived under applicable consumer law. Customers using the Services or Products for their trade, business, craft, or profession do not receive statutory consumer rights solely because they are individuals.
Accepting these Terms, creating an API key, or making an API request does not by itself waive a Consumer's statutory right of withdrawal. Where a right of withdrawal applies, we will provide the legally required information and obtain any required request, consent, or acknowledgement through the applicable checkout or order process.
A Consumer may exercise an applicable right of withdrawal by sending a clear statement to info@mappinest.com. If a Consumer asks us to begin providing a paid Service before the withdrawal period expires, the Consumer may be responsible for the proportionate value supplied before withdrawal where applicable law allows it.
Account cancellation or suspension
- You may cancel a recurring paid plan or disable PAYG through the available account controls or by contacting us. Disabling PAYG stops new PAYG usage from being authorized after the change takes effect, but charges already incurred remain payable. Unless your checkout terms or order form state otherwise, cancellation of a recurring plan takes effect at the end of the current billing period and does not create a pro-rated refund.
- Cancelling paid billing does not automatically delete your account or Customer Content. You may request account deletion through the available account controls or by contacting us. Export any Customer Content you want to retain before requesting deletion. Once deletion is completed, access to the account ends and Customer Content is removed from active systems. Temporary copies may remain in caches, backups, or recovery systems until they expire through normal retention cycles. Billing, security, and legal records may be retained as described in the Privacy Policy.
- We may suspend or terminate access immediately where reasonably necessary to address a material breach, non-payment, fraud, unlawful activity, a security risk, or harm to the Services or another person. Where the issue can reasonably be remedied, we will normally provide notice and an opportunity to correct it before termination.
- We may discontinue your account or a paid Service without cause by giving at least 30 days' notice. In that case, we will refund any prepaid recurring fees that relate to the period after termination. This does not limit any mandatory rights available to Consumers.
Changes to services or terms
- We may update these Terms when our Services, Products, business practices, or legal obligations change. The revised Terms will show a new effective date and will not apply retroactively.
- We will provide registered users with reasonable advance notice by email or through the Services before a material change takes effect. We will normally provide at least 30 days' notice. A shorter period may apply where a change is required by law, addresses an urgent security risk, or cannot reasonably be delayed.
- If a material change significantly disadvantages you, you may stop using the affected Services and cancel the relevant paid plan before the change takes effect. Charges already incurred remain payable. Continued use after the effective date constitutes acceptance of the revised Terms where permitted by law.
- We may update features and APIs over time. We will use reasonable efforts to give advance notice of a material backwards-incompatible change, except where an urgent legal, security, or operational issue requires faster action.
Feedback
You are not required to provide feedback. If you choose to send us suggestions, ideas, or feature requests, you grant Mappinest a non-exclusive, worldwide, royalty-free, perpetual license to use that feedback to develop, improve, operate, and promote the Services and Products. This allows us to keep improvements already made from feedback without owing compensation.
This license applies only to feedback. It does not transfer ownership of Customer Content, confidential information, or personal data, and we will not publicly identify you as the source without your permission.
Disclaimers
We will provide the Services with reasonable care and skill. Unless an order form, service-level agreement, or other written agreement states otherwise, the Services are provided on an available basis. We do not guarantee that every feature will be uninterrupted, error-free, or suitable for every Customer's intended use.
Maps, datasets, styles, software, and other material provided by customers or third parties may contain errors, omissions, or separate license conditions. Mappinest does not control or endorse that material merely because it can be used through the Services. You are responsible for checking whether it is accurate, licensed, and suitable for your use case.
You are responsible for configuring your integrations, testing important workflows, protecting API keys, and maintaining independent copies of Customer Content appropriate to your risk and continuity requirements.
Nothing in this section excludes an express commitment in an applicable order form, service-level agreement, or data processing agreement. It also does not exclude a warranty, remedy, or other right that cannot lawfully be limited, including mandatory rights available to Consumers.
Limitation of liability
Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, death or personal injury caused by negligence, fraud, breach of confidentiality or data-protection obligations, infringement of intellectual property rights, or any other liability that cannot be excluded or limited under applicable law.
For a Customer who is not a Consumer, and to the extent permitted by law, Mappinest is not liable for indirect or consequential loss, loss of profit, revenue, business opportunity, goodwill, or anticipated savings. This exclusion does not apply where the loss was caused by a matter listed in the paragraph above.
For a Customer who is not a Consumer, Mappinest's total aggregate liability arising from the Services, Products, and these Terms is limited to the fees paid or payable by that Customer for the affected Services or Products during the 12 months immediately preceding the event giving rise to the claim. An order form or service-level agreement may set a different liability cap for the services it covers.
Consumers retain all remedies and liability protections that cannot be limited under applicable law. Claims are subject to the limitation periods provided by applicable law. These Terms do not impose a separate one-year claim deadline.
Account and usage integrity
- Do not create or coordinate multiple accounts to avoid plan quotas, rate limits, suspensions, or charges. If verified usage was split across accounts for that purpose, Mappinest may aggregate it, charge the amount that would otherwise have applied, and suspend or terminate the affected accounts under these Terms.
- We may review Mappinest's own service and billing records to verify compliance with these Terms. If those records provide reasonable evidence of a material violation or underpayment, we may ask you for information reasonably necessary to investigate it. Any request must be proportionate, limited to the relevant issue, and handled subject to appropriate confidentiality obligations. You are not required to provide access to your premises, unrelated records, or internal systems unless you separately agree in writing or applicable law requires it.
Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Croatia, without regard to conflict-of-law rules. For Customers who are not Consumers, disputes are subject to the jurisdiction of the competent court determined by Mappinest's registered seat, unless an applicable order form states otherwise.
If you are a Consumer, this choice of law and jurisdiction does not deprive you of mandatory protections or access to a court available under the law that applies to you. Nothing in these Terms limits a Consumer's right to bring proceedings before a court that has jurisdiction under mandatory consumer law.
